General

Real Estate Settlement Procedures Act
On March 14, 2008, the Department of Housing and Urban Development (HUD) published a proposed rule on the Real Estate Settlement Procedures Act (RESPA). HUD proposes to simplify and improve the disclosure requirements for mortgage settlement costs under RESPA, to protect consumers from unnecessarily high settlement costs. Among other changes, the proposal standardizes the Good Faith Estimate (GFE) form to make it easier to use for shopping among settlement service providers. Comments are due on June 12, 2008.

    Proposed Revised Rulemaking on Business Opportunity Rule
    On March 26, 2008, the Federal Trade Commission (FTC) published a proposal on the Business Opportunity Rule. The revised Notice of Proposed Rulemaking amends Part 437, the trade regulation rule governing sale of business opportunities that are not covered by the amended Franchise Rule. It would require business opportunity sellers to furnish prospective purchasers with specific information that is material to the consumer's decision as to whether to purchase a business opportunity and which should help the purchaser identify fraudulent offerings. The proposed rule also would prohibit other acts or practices that are unfair or deceptive within the meaning of Section 5 of the Federal Trade Commission Act (the ``FTC Act''). Comments are due on May 27, 2008. Rebuttal comments are due on June 16, 2008.

    Minimum Training Requirements for Entry-Level Commercial Motor Vehicle Operators
    On December 26, 2007, the Federal Motor Carrier Safety Administration (FMCSA) published a proposed rule that would expand federal training requirements for anyone applying for new or upgraded commercial driver’s license (CDL) to successfully complete both classroom and behind-the-wheel training from an accredited institution or program. Proof of such training would have to be provided to the state CDL issuing authority. The rule would exclude commercial drivers who currently possess a CDL or obtain one prior to the rule taking effect. Comments on the proposed rule are due by May 23, 2008
