I have a small business in a bldg that i rent. According to the info i have read, i am supposed to send out a 1099 to the landlord because i pay over $600 a mo. I have tried to get her SS/EIN but she refuses. How can i file the right paperwork if she doesn't cooperate?
Unfortunately that does happen. There are two areas you can check that might list her EIN#. First check your lease. Sometimes the EIN number is listed somewhere on your lease document. Second most states have an online business registration where you register your corporation or fictitious name. Again some states list the EIN# on there. Finally if you are still unsuccessful you can send in the 1099 without the EIN number and just the name and address. The IRS has started to crack down on people not filing 1099 and the fine can be as much at $50.00 per 1099. This should protect you from that situation.

You might check with your accountant. Unless the law changed recently, you don't need to give a 1099 to your landlord. You issue 1099s to independent contractors and others who perform some type of service for you and to whom you pay $600 or more in calendar year. Rent, utilities, etc. are considered normal expenses involved in operating a business and are not subject to a 1099.
