A customer entered our small convenience store and sat at a table and blacked out and was there for over 20 minutes and no one called 911. Am I liable for anything?
Do you have liability insurance? Without knowing the details of your situation, I would suggest that you speak with your insurance company, and perhaps a small business attorney to better understand your options and responsibilities in this situation.
Was this customer okay after they came to? I am amazed that no one called 911, what were they all doing? What type of business was it and what were the conditions in the building? I would say you need to talk with your insurance company. If not for a legal standpoint at least morally.
That is a very technical matter and would likely be settle in court if the person (hoping that he didnt die/or any internal damages) decided to sue you.
It also depends on your establishment set-up, how tables are position. your line of sight. do you have knowledge that he pass out and just didnt called 911? or were you as surprise that he pass out.
Do you have a waitress that roam the table ?
These are just the basic information needed.
