Can I create a compagny in the USA as a non citizen...?

Hello,

I live in the USA for the past 5 years with a working permit I94. I have social security number and taxe ID.

I would like to create a compagny in nevada with my wife. (she's canadian and has a green card but not me).

Is it possible to create a compagny together? (as partenership)

Do I need a different visa?

I know that I cannot work with any other compagny than the one that hire me with my actuel visa but Can I create my compagny?

Hi Ghislain, as BriaS mentioned earlier, I would check out our blog post Starting a Business in the U.S. as a Foreign National . I would also recommend you enter your zip code at  SBA Direct for a list of local, free business organizations in your area that can help you start your business.

Hi ghislain,   If you are a US resident and are living in USA for 5 years then I think you shouldn't have any problem in opening the company in US. You should already have green card and I think this is a website that can help you further http://www.usafis.org

Although you are already in the U.S. and have a social security, you are still only allowed to work for your current company. I am guessing the process would be accurately reflected in this article because you are not a permanent resident. You may want to visit with a counselor at your nearest small business development center or SCORE office. They can tell you what the laws are and, if you can legally start a business, help you through the process so you don't make mistakes. Because you have a work visa to work for your current company, would that company allow you to start a business? They may consider it to be a conflict of interest.
