My friend and I want to startup a new business in US (Chicago, Illinois) and we want to register a partnership firm. The problem is my friend is in India. Can he become a legal partner? He has business VISA for US and keeps traveling to US.
If not, is there any other way he can legally be part of the firm? I am a Green Card holder.

S-corporations allow foreign shareholders, so I would consider that as a viable way to allow a non-US resident to have a partnership in your company. Also be sure to talk to a attourney ,as there are issues that can arise with trying to make a non US resident part of a company in terms of being a charter member.
