I'm not sure how you got a credit card processing and merchant accounts, without having an EIN, because every bank & processor I've ever dealt with  did a credit check for the business, which requires a tax ID number.   If the question is, do I need to incorporate or become an LLC to get an EIN, the answer is no.  You just have to fill out IRS form SS-4, then follow the directions on the form to get the tax ID number.  You will have to give the IRS your SSN in order to get the EIN.   Business licenses vary by state and even municipality.  For example, in most states, you need to collect sales tax on in-state purchases (but not out of state), assuming your state has a sales tax and suits, if that's what you're selling, is a taxable item.   You should also register a trade name at minimum.  If you don't and you just get an EIN, someone else can come along and register the trade name you're doing business under and your out-of-luck.   There may be other reasons to incorporate or form an LLC, but only your accountant and tax adviser, along with your input, can make that decision.
