I was hired as a Hostel Manager in SF,CA. The owner never gave me any applications to fill out, and when I kept requesting one for legal reasons, he kept putting me off. When it was time to make payroll, the Owner put me off again, and would not speak with me about this. i have worked there for about three and a half weeks. I found out that there are about four other employees working there without the proper legal documents (all US citizens) in order to pay their taxes. I have NOT been paid by my employer, and when I stated that I am going to speak to someone from Employees Rights, I was fired that same day. I am taking him to small claims court on the 15th on November 2010. isn't it a fact that any employer that hires someone employed in their place of business, has the right to fill out an application form, and tax forms? What else can I do to make sure that I will be paid my wages on that date? Any help is appreciated.
