Entity Changes & EIN Confusion

This entails more than one question, I hope that I can get some assistant with this because I am lost!

 

1. I had seperated my company so I can have one retail and one construction, when the lawyer set up the construction there was a new EIN applied to that company.  However, there were complications and the new company was then switched to the EIN for the old company and the new company then received the new EIN.  Now the problem I have is the letter states from the IRS the new company with the new EIN, not vice versus.  When I called the IRS they don't have the companies switched around, but all the legal papers have the companies switched.  Which form do I need to fill out so I can have the correct EIN to each company?

 

2.  I have the Articles of Amdendments for each of the companies, however, once again they do not state EIN #'s.  I have already started the paperwork for the city and state switching the EIN #'s for our permits.  I can not find any forms to get the legal form stating this, where do I find this form?

 

I tried to make this switch nice and easy, however the lawyers like to make it nice and difficult.  I thank you in advance for your help.

I would suggest you start here: http://www.irs.gov/businesses/small/article/0,,id=99903,00.html But, it seems that you only need to switch your paperwork to match that of the IRS. Your lawyer - who set this up - should be willing to fix this for you.

The IRS does not allow the switching of EIN's between business entities. It would be like changing SSN's between people. I hope this helps.
