An employee fell 12 feet from a second floor today. He opened the gate and was moving a heavy carton. The handle broke and he fell back thru the open gate and landed on the floor below. Went to the er and is staying the night for observations. What type of fine or penalty can I expect to receive?

Very sorry to hear this. Unfortunately, injuries on the job happen more often than anyone would like.
