I teach business start-up to artists and designers and have international students on F1 visas who want to open business in the US after they graduate. I understand that processes vary state to state and that the foreign national will need a US resident representative, but can that representative also sponsor the business owner to work for the business? In other words, how does a foreign national both open AND work for a business within the United States?
As I understand it, certain visas statuses, like H1B status, allow you to work exclusively for
your employer. If you were to start your own business, you most likely
would not be able to work for your own business, and doing so may violate
the terms of your H1B status.
Depending on your situation, you may
be able to act as a silent investor, but this is a very delicate topic, and can vary depending on the terms of your visa. I suggest you contact a specialist at your Embassy.
