Hi all! I am a freelance makeup artist and want to start up a professional service and really be committed to this. Any advice on the legalities of starting this service business?

In my state, you need a cosmotology license to apply make-up to another person, so be sure to check your state requirements.

Do you mean Freelance Makeup Artist for the film & television industry? If so, you'll probably be hired on a per diem basis, which means you'll need a Tax ID number, unless you want to give your SSN to everyone who hires you. Save your receipts for makeup, application supplies, tools, etc. We have a client who is a video producer, and he tells me it's difficult to find makeup artists where he's located. I'd suggest googling the names of production companies and make sure they have your contact information. A quarterly email just to remind them of your name and how to reach you would probably be helpful. He tells me most of the makeup artist's he hires just do business under their SSN, and he sends them a 1099 at tax season. This isn't intended as tax advice to you, just anecdotal information. It's worth checking out with your accountant.

would think that one of the biggest challenges in this industry would be making a name for yourself. how do you plan on promoting yourself and getting noticed? What is your target market going to be?

Since you're in the cosmetics industry, you may want to check out the Permit Me Tool to see what licenses and permits are required. I'm assuming that you are planning to start this business at home?
If you are creating your own cosmetics, there may a legal issue of ensuring that they are safe for human use. I don't know all the intracacies of it, but I know it can be a real chore. If, however, you are representing established lines of cosmetics, then very little legal work will be required. Mostly you will need to decide if your business should be a sole proprietorship or one of the various corporate entities. You may need to file a 'dba' (Doing Business As) at your county courthouse. A chat with an experienced bookkeeper can go a long way in the beginning planning. As I write this, I am pondering the issue of a 'cosmetology license'. I believe I have heard of such a license, but I am not certain how widespread its use is, or which states have such a requirment. Christine's link will help you out of this I am sure.
