Hiring Sales Reps

Greetings,

 

I'm starting a small athletic apparel company (LLC) in Texas, and I am planning on bringing on board ten to fifteen part-time contractual Sales Representatives.

 

I have already written up a contract for the Reps. However, I needed to know what exact tax documentation I need to send them before they can start? W-9?

 

I would greatly appreciate any advice or additional information.

1099 is probably the way to go, at least it would be here in California. In your place, I'd also look into setting myself up on the web and then getting an affiliate program going. For all intensive purposes this would work like a group of salespeople on the web. Look into Share A Sale for a good affiliate program. Given your product I think the web side could be very successful for you.

Some resources that can help you: Texas Secretary of State: http://www.sos.state.tx.us/ Texas Work Force Commission: http://www.twc.state.tx.us/ SCORE: http://www.score.org/ SBDC: Small Business Development Center - search for one in your city. IRS: http://www.irs.gov/businesses/small/index.html All of these can help you figure out what you need before you hire - all are free - it is hard to answer questions like this as every state is different and every business is different. Start with these resources.

Hi,   yes if you have a contractor wokring for you then I am pretty sure it will be the 1099, and here's a link to one for you to read: http://www.irs.gov/pub/irs-pdf/f1099msc.pdf   Payers who file 250 or more Form 1099 reports must file all of them electronically with the IRS also, but I doubt you will be over that if it a new business, however you only have to file one if the contractor earns more than $600 a year, and of course I would hope they would for you.   The other thing which the last commentor mentioned, is getting online sales staff to work for you selling your stuff. I recommend Commission Junction (www.cj.com) as one of the better networks.   If you do go down that path, then you need to ensure you get your affiliates to fill in a W9 or a W8 (for non US affiliates). These can be filled out and scanned and sent back to you which makes it very easy.   All the best with your business   Cheers   Paul Collins
