I believe it's different for each State; you might want to contact the State department that handles employee affairs in your State and just directly ask them. You could also speak with an Attorney who deals with Employee rights. Get official information, not he said, she said information. ;)

The length of time that you will be required to retain employee health records will be dictated bymany things. You need to look at State Law, Federal law, your company's policy, OSHA, Worker's compensation,Insurance policies, contracts, etc. This probably explains why you have been given conflicting information. Once you do your research, you will need to go with the policy/law/contract etc that requires you to keep them them for the longest period of time.
