On July 1,2008 My father in-law transferred the ownership of our small video rental business to me. I received a new EIN number under my name and both state and federal taxes are listed to me. On October 4,2008 my loving father in-law lost his battle to cancer and two months later my mother in-law informed me that the business was never legally mine. On January 21,2009 she had decided she wanted the business back and even went as far as to have the landlord change the locks. I am still liable for the taxes and I had signed a lease until Oct 1,2009. I am at a loss and I need advice before I decide if I want to fight this.
You must speak with a legal professional. There was post earlier from a rep for fizzlaw.com (I think that was the name). The site will allow you to read reviews of local attorneys and pick one that is right for you.
I know speaking with an attorney will cost quite a bit of money, but you need the advice of an expert.
One other option is to contact the business law departments of local universities. I've seen where their professors offer short sessions at no cost.
I know this isn't the advice you were looking for, but I hope it points you in the right direction.
