Illegal?

I have a couple questions.

 

I am a manager at a pizza franchise. At first I was hired as a driver and then promoted to manager. A couple months ago, my GM told me that I was being demoted the next week back to a driver. As a result, my pay was cut but they still let me work as a manager. I feel they demoted me w/o communicating anything to me. They had multiple reasons why but never once communicated to me about their issues w/me(When I say they, I mean the GM, the owner of the franchise and the DM). Is  this legal? Can someone be demoted w/o any form of communication?

 

My 2nd question is my friend, who was also a manager here as well, suddenly quit 2 wees ago. Yesterday, he received his final paycheck but it wasn't an official check from our company. The owner had written a personal check to my friend. So he has no paystub to prove or show any deductions and no taxes were taken out either.Another friend of mine told me that this is illegal! Is it?

 

If one of these, of both, is illegal, what can I do? I feel my friend and I were screwed over big time! Any help or advice would be appreciated! Thanks!

trevans9979, Sorry to hear about your situation. answering your second question first, your friend should verify everything when he gets his W2 at the end of the year. This will have his total pay and how much they took out for taxes. If it doesn't include the last paycheck, he should ask the owner about it. They need to pay taxes. What state are you in? You can usually find who to connect at the Department Labor in your state. State Laws also dictate what is legal and illegal in turns of employees. JimD

really sorry to heart that i think what they do for your friend is illegal your friend's final paycheck should be the official check. for you if they want to demote you they must have a reasoned Statement

Laws vary by state. Many states consider employment to be 'at will' and the employer can change your title or demote you if it is in the best interests of the business. The fact that you were demoted and salary decreased and your friend received a personal check sends up red flags that the business may be in trouble. You may want to contact your state department of labor. If there are issues with the business, you and your friend will want to have all the information you can to be prepared for whatever might happen.
