Is it legal to resell a restaurants food?

I have been searching all over the place today for the answer to this question.  I have not been able to find anything on any search engine and am not sure where to look next. Thank you guys!

I do not know off hand and the legal requirements would probably be at the state level unless you are selling across state lines. Start with your state's health department - ask them as well as ask them about food licenses. Also, make sure you have the permission of the restaurant. Whatever they produce (even if you buy it from them) more then likely legally remains their property.

Health reguations are very strict about food sold to the public. My guess is that you cannot resell it. In my area caterers and some specialty restaurants have a program called Chefs to the Rescue. Through the program, participating businesses donate their leftover food to soup kitchens and rescue missions. I doubt that many would participate in such a program if they could resell the food. If you were to sell the food and someone got sick from eating it, the restaurant could be held responsible.
