If you are only occasionally selling a painting you shouldn't need to create a business. You can list the income on your taxes as hobby income and you can deduct the cost of the canvas, paints, etc. If you plan to regularly sell paintings, then you may need to create a business. You can find information on the IRS web site by doing a search for hobby business.
