The law is very specific about the difference between an independent
contractor and an employee. If you treated him as an employee but paid him
like an independent contractor, you could have many problems. You may need to
discuss the matter with an attorney to determine exactly where you stand.

Hi, Another great resource is SCORE, one of SBA's resource partners. SCORE is a nonprofit association comprised of thousands of volunteer business counselors throughout the country. They are trained to serve as advisors and mentors to aspiring entrepreneurs and business owners (at no cost to you). You can find your local office or set up an online meeting to chat with someone about your questions.
This from a CPA: If you've used a CPA, you might want to have that person
interface with auditor... what I find (and i'm in my fifties) is that a
veteran tax practitioner on your side of the argument will probably mean any
discussions are more evenly balanced... probably mean some topics get neatly
avoided... sometimes seems to result in more professional treatment from
auditor, etc.
BTW, I don't much experience with AZ auditors (just a little)...

I don't have an accountant. I have let QB do all the reporting etc. It has
worked well. I had a vendor that I report as a 1099 go and apply for benefits
from the department that handles unemployment. He did not apply for
unemployment but they automatically included it. When I told them he was not
an employee they initiated an audit. We are very small, just two employees.
