Overseas company branching to the US

Hi there,

 

A UK based company is looking into branching to the US (employing US citizens) and have a few questions on how to get started.

 

First, what are the first steps to take in order to do so? Who do we contact?

 

Second, what are the pros and cons to opening a new branch of the company in

the US as opposed to simply starting a new company in the US?

 

Third, would a Visa be required? If so, can we register the new branch/company in a US employee's name instead?

Hi joknatson, Businesses in the United States are governed at the state level, so once you choose a state in which your business will reside in, you will register with that particular state. After establishing an agent at a valid address, you can follow the 10 steps to starting a business. We wrote a great blog: Starting a Business as a Foreign National that provides steps and information about the process. USA.gov and the Department of State also has some useful information assisting foreign companies in the United States. Does anyone else have more comments? Especially to the pros and cons to opening a branch versus starting a new company in the U.S.?
