Qualification Requirement of Government positions being filled by Contractors

Is it legal for a Contractor to require a positive education for a position that is not positive edcuation government position.

 

Example: Human Resources Specialists are not classified as positive education positons, however, FPMI in it's recruitment for this position (in a federal agency), is requiring a BS, what's up with that. Is this legal?.

Hmm, I'm not familiar with this area, but perhaps you could call the agency's ombudsman or EEOC contact for more information or a clarification?
