I had a friend who made up a domain name and registered it only to have the people who have that name as a trademark come after her. They did not still have the domain name but eveidently some phrase in the name was still held as a trademark. It's important to make sure the name you want to use is legal. I found that information here on this site. I don't remember if it was under copywrite, or trademark, or what heading. But I was so happy to come across it for her.
