Very important (which is the best choice)

Well I am starting my own little music company (record/music publishing company).     It is called HollowayTwins Productions and I was thinking about choosing the option Sole Proprietor as a choice. And it is basically for me and my brother for starters. And since my last name is Holloway and that is in the name of the title... Do I need to still get a doing business as certificate? Can someone please help me with this?

A good article to check out is Differences in Legal Structures - Which Structure is Right for You?. Many states require a sole proprietor to operate under their personal name unless they formally file a trade name, or a 'Doing Business As' (DBA) name. Hope this helps. JimD

Whether you need to register the business name will depend on the requirements in your state. In my state, all businesses are now required to register, even if they use the owner's name as part of the business name. If you and your brother will co-own the business you may want to register as a partnership and have an attorney draw up a partnership agreement.
