I emailed NJ Division of Revenue, but I received an unsatisfactory response with multiple typographical errors that did not answer my question. So maybe someone here might know!
I have a New Jersey Corporation. I wish to use a secondary name sometimes for some purposes (to avoid product line confusion, etc.).
Below is the information I found on the NJ website. But I cannot directly determine two things from this information:
1) Do you have to include Inc. in the alternate name (since it's a corporation), or can you simply call it something like Magic Land, without using the Inc.?
2) There is another company in New Jersey that uses the same name I wish to use. It's in a non-competing, different business category, so I don't see any conflict. The wording below says registering an alternate name for your business 'not subject to the same name availablility requirements as those for the business entity name'. I take that to mean 'You can use the same name somebody else is using as long as your use is an alternate name, and not the primary name of your company, and it's not going to cause any marketplace confusion'. I wish they would spelll it out like that, but they don't.
So does anybody here know about these two points I'm raising?
Thanks in advance for any insights.
After a business entity has been established or receives authorization to do business in New Jersey, it may legally do business under an alternate name once the alternate name is registered. This applies to profit and non-profit corporations, limited liability companies and limited partnerships.
The selection of the alternate name is not subject to name availability requirements as those for the business entity name. Although the registration of the alternate name will not provide exclusive rights to its usage, it will legally link the name to the corporate entity and enable the business to use the alternate name for financial, advertising and other business purposes.
