I registered two domain names that were exactly the same as my business name under .org and .net, and plan on using one of those. I would have purchased the .com domain just to keep it out of circulation, so I could avoid confusion from another business entity. At that time the .com was taken by a domain name broker who was holding it to speculate resale. Not being able to afford to purchase this .com domain, I waited hoping the domain registration would expire, so that I could purchase it. It has not. Thinking I may need to change my business name I called my state SOS to discuss. I got the information that I needed to register a DBA, but I was also informed that my business name was not secured nationally, but was protected only within the state. I was informed to trademark or copyright my name for national protection. Researching at the website, I discovered that I must trademark my business name to protect it. There was no mention of copyright. I performed the TESS search, and it came up that no TESS records were found to match the criteria. Here is my question: As I am not interested in using this .com domain name, but owning it just to protect it&#39;s use, if I had a registered trademark for my business name which is identical to the domain name (except the domain name has no spaces between the 3 words that make up my business name), by having my business name trademarked, would that nullify the use of this .com domain name by any entity other than my business? In other words, If another business entity purchased this .com domain, would they be in violation of my trademark registration, if they used it?
