In this webinar, Jane Kim, attorney at Wright Lindsey Jennings, will share practical information to consider when classifying workers and negotiating contracts. Get an overview of worker classification tests and how misclassification may impact legal, administrative, and tax liabilities.
She will clarify what determines if a worker is an independent contractor or employee, since guidance from the Internal Revenue Service, the Department of Labor, and the courts doesn’t always align.
If you are a small business owner, you are responsible for appropriately classifying workers in order to comply with DOL and IRS rules.
If you work as an independent contractor, you need to be aware of the rules for worker classification so that you can ensure that the nature of your contracts align with your independent contractor status.
This session will also provide an update on the Biden-era DOL independent contractor rule that went into effect in March 2024. That rule narrowed the definition of “independent contractor” under the Fair Labor Standards Act, but the Trump DOL announced on May 1 that it will no longer enforce the rule. Although not formally rescinded, the DOL is reconsidering the Biden-era rule and is expected to significantly revise or replace the rule upon completion of its review.
