In response to ongoing challenges with widespread permitting delays that have stalled recovery and rebuilding efforts in states like California, President Donald J. Trump has empowered the SBA to implement new regulations through a new executive order. These regulatory changes will enable SBA disaster borrowers to bypass certain state and local permitting requirements if the borrower has been unable to obtain requisite approvals after an extended period of time. The new regulations will allow for the timely use of approved SBA disaster loans and rapid rebuilding.
Eligibility: If you have applied for a local permit more than 60 days ago, but still haven't received approval, you may qualify for this self-certification option.
Next Steps to Use the Builder Self-Certification Option
- Discuss with your contractor/builder: Review your situation with your contractor to confirm you meet the eligibility criteria.

This form must be signed by you (the borrower). This form allows SBA to move forward with the builder-certification process. - Builder Certification
This form must be signed by your builder/contractor. It certifies that the planned repairs/reconstruction comply with applicable building codes, safety measures, and other substantive requirements and that your builder will continue to follow all applicable state and local rules other than the permitting or other approval requirements the regulatory changes allow them to bypass. If you do not have a builder/contractor, and you are the one overseeing repairs and getting permits or other approvals and you meet the requirements in the new regulations, you may sign the certification.
Important Document Requirement: Ensure necessary signatures, address, and the loan number match loan documents exactly to prevent delays in processing.

- Upload the completed signed forms: Log back into your MySBA Portal, upload both signed forms, and submit your request. SBA will review the submission. A case manager will contact you with next steps or any additional requirements.
If Your Loan Was Cancelled: If your loan was previously cancelled, you may be eligible to have it reinstated. Please send a secure message through your MySBA Portal to request reinstatement and discuss your options. If reinstated, you may then qualify for the builder self-certification process described above.
